Terms of Service

These Terms of Service (“Terms”) govern your use of Replypact, a job portal for IT roles in the DACH region. By creating an account or using the service you agree to these Terms. If you do not agree, do not use Replypact.
Replypact is currently in private preview. Features and these Terms may change as the product develops; the provider responsible for the service is identified in the Imprint.
The agreement and who may use Replypact
You must be at least 18 years old and able to enter into a binding contract to use Replypact. You may hold one account and must provide accurate information.
Registration as a candidate or scout is by invitation only; companies may register directly. We may decline or revoke access at our discretion, in particular to enforce these Terms or protect the platform.
The two core rules
Replypact exists to remove silence from hiring, and two rules apply to everyone:
- Companies owe every rejected candidate structured feedback within the stated deadline. Ghosting, silence, and form rejections are not permitted.
- Candidates hold a limited number of active applications at a time, so each application is made with intent. New applications are blocked once that limit is reached, until a slot is freed.
These are not guidelines but enforced platform mechanics, and using Replypact means accepting them.
Companies
As a company you agree to respond to applications within the response deadline shown for each role, to provide honest, specific feedback to every candidate you reject, and to keep your roles and company status accurate.
If feedback you owe becomes overdue, the platform may block you from receiving new applications until you provide it. Repeated failure to meet these obligations may lead to suspension. You are responsible for the lawfulness and accuracy of the feedback and ratings you submit.
Candidates
As a candidate you agree to apply in good faith to roles you are genuinely interested in, and to keep your profile accurate. Your active application slots, withdrawal cooldowns, and the consequences of an employer missing a deadline work as described in the product.
You own the content you add (profile, CV fields, cover notes) and are responsible for its accuracy and for not infringing anyone else’s rights.
Scouts
As a scout (external recruiter) you may invite candidates with an endorsement and, where a company has authorized you, act on that company’s behalf. You agree to make endorsements truthfully, to act only within an active authorization, and to include the required third-party disclosure when you contact candidates on a company’s behalf.
Interest you signal for a company is attributed to that company and counts against its limits. A company may revoke your authorization at any time, and so may you.
Acceptable use
You agree not to misuse Replypact. In particular, you must not:
- create accounts by automated means, circumvent the invitation system, or share invite codes to mass-create accounts;
- submit false, misleading, discriminatory, or unlawful content, feedback, or ratings;
- scrape, harvest, or collect other users’ data, or contact them outside the platform’s intended flow;
- attempt to gain unauthorized access to the service, interfere with its operation, or evade rate limits and enforcement.
Suspension and termination
You may stop using Replypact and delete your account at any time. We may suspend or terminate accounts that breach these Terms or threaten the platform or its users, including by deactivating an account or, where abuse is coordinated through invitations, accounts in the same invitation subtree.
Some records are retained after an account ends as described in the Privacy Policy — notably the anonymised feedback an account gave or received, which forms part of the platform’s accountability record.
Your content and our service
You keep the rights to the content you submit and grant us the limited permission needed to host, display, and share it for the purpose of operating the service (for example, showing your application to the company you applied to). How we handle personal data is set out in the Privacy Policy, which forms part of your use of Replypact.
Disclaimers
Replypact is a marketplace that connects candidates, companies, and scouts. We are not a party to any employment or engagement that results, do not employ candidates, and do not guarantee any application, response, hire, or outcome. During the private preview the service is provided “as is” and may be incomplete, interrupted, or changed.
Liability
Nothing in these Terms limits liability that cannot be limited by law, including for injury to life, body, or health, or for intent or gross negligence. Subject to that, our liability for slight negligence is limited to the breach of essential contractual obligations and to the foreseeable, typical damage. Your statutory rights as a consumer are not affected.
Changes to these Terms
We may update these Terms as the product develops. We will change the “last updated” date above and, for material changes affecting registered users, give reasonable notice. Continuing to use Replypact after a change means you accept the updated Terms.
Governing law and contact
These Terms and your use of Replypact are governed by the law of the provider’s seat as identified in the Imprint — German law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of your country of residence remain unaffected. For any question about these Terms, contact us using the details in the Imprint.
